EU Machinery Regulation 2027: A Busbar Machine Procurement Checklist

A busbar machine ordered in the second half of 2026 may be delivered, integrated, or first placed on the EU market around the 2027 regulatory transition. If the contract only asks for a “CE certificate,” the buyer and supplier may not have agreed what the final compliance package actually contains.

The practical response is to define the machine configuration, the applicable milestone, the conformity route, and the party responsible for each document. Those decisions should be made before the equipment is packed, particularly where separate punching, bending, and handling systems will be integrated.

This is a procurement checklist, not legal advice or a declaration that a particular DH CNC configuration meets the forthcoming regulation. Obtain project-specific assessment from appropriately qualified parties.

Use the Market-Placement Milestone, Not the Purchase-Order Date

The European Commission’s machinery guidance states that Regulation (EU) 2023/1230 applies on a mandatory basis from 20 January 2027. It also identifies the current Machinery Directive 2006/42/EC as the compliance basis for machinery placed on the EU market before that date.

An early deposit does not, by itself, establish when a machine has been placed on the market. Delivery terms, the actual supply arrangement, and the relevant legal circumstances need review. Likewise, a factory test date should not be used as an automatic proxy for the applicable regulatory milestone.

Add a transition clause to the procurement plan: identify who confirms the applicable regime, what evidence supports that decision, and how a schedule change will be handled. Ask for a written review if shipment or integration moves across the expected boundary.

Avoid making the order dependent on an unexamined assumption that “2026 manufacture” means “old rules.” The configuration and supply circumstances are what the responsible compliance team must assess.

Identify the Machine and the Party Responsible for It

Start with a clear boundary drawing. Does the order cover one complete workstation, partly completed machinery, or a group of machines intended to operate together? Does a local integrator add a loader, conveyor, robot, fence, or shared control system?

EU-OSHA’s overview of Regulation 2023/1230 describes its coverage of machinery, related products, partly completed machinery, and the responsibilities of manufacturers and other economic operators. Its discussion of substantial modifications is especially relevant when the delivered machine will be changed after purchase.

Create a responsibility map for the equipment manufacturer, importer, integrator, and end user. Assign the final configuration drawing, risk-assessment coordination, declarations, instructions, validation records, and change control. Do not leave responsibility with “the supplier” when several suppliers are involved.

Ask for the Conformity Route, Not a Generic CE Certificate

Punching, bending, loading arrangements, safety functions, and the final integration can affect the assessment. Do not assume every hydraulic machine follows the same route or that every CNC machine requires the same third-party involvement.

The Commission expressly warns that voluntary or unregulated certificates are not a recognized substitute for the required compliance process. If a notified body is involved, verify that its role and scope correspond to the assessment being performed.

Ask the supplier to connect its declaration and supporting evidence to the serial number, configuration, and supplied options. A certificate for a similarly named machine or an earlier arrangement does not settle the status of the ordered equipment.

The useful procurement question is: “Which procedure applies to this configuration, who carries it out, and what evidence will be delivered?” That is more precise than asking whether the factory “has CE.”

Cover Software and Remote Service in the Safety File

The new regulation addresses safety-related implications of connected equipment and software. For the purchaser, a practical starting point is a controlled record of software versions, safety-related parameters, backup arrangements, and authorized access.

Agree how remote support is enabled, who authorizes a session, and how a change is recorded. Distinguish a routine diagnostic connection from modifying logic or parameters that affect the machine’s safe behavior. The service contract should identify when changes require review, testing, or revised documentation.

Require a recoverable configuration baseline at handover. A backup is useful only if the team knows which machine and version it belongs to, how it can be restored, and what checks are required afterward.

Put Handover Documents on the Delivery Schedule

Treat documentation as a planned deliverable, with review dates before final acceptance. The following is a purchasing structure; the exact legally required content and access conditions must be confirmed for the project.

Digital instructions are subject to conditions; do not assume that supplying a download link resolves every format or availability requirement. Confirm the applicable rules and user needs. Similarly, agree what technical evidence the buyer receives without assuming that all proprietary technical documentation must be publicly disclosed.

Where practical, review sample documents during the factory verification process. A late discovery that the documentation does not match the equipment can be harder to resolve than a missing spare part.

Use FAT and SAT to Verify the Agreed Configuration

Factory and site acceptance should test the purchased functions and confirm the controlled configuration. Include material handling, guarding interfaces, operating modes, documentation, and the representative production parts agreed in the order.

The busbar machine FAT/SAT protocol provides a structure for those checks. Passing the protocol does not replace the conformity-assessment process, and a successful production demonstration does not close unresolved safety or documentation issues.

Before shipment, identify every open item, its owner, the required evidence, and the acceptance consequence. After installation, confirm that integration has not changed the accepted arrangement without review.

A well-prepared order can cross the 2027 transition without treating compliance as a last-minute paperwork exercise. The necessary work is specific: establish the applicable basis, classify the actual machine, control changes, and align the delivered equipment with its evidence.

Does ordering a machine in 2026 guarantee that the old Machinery Directive applies?

No. The purchase-order date alone does not establish the applicable legal regime. Confirm the relevant placing-on-the-market or putting-into-service circumstances and the transition provisions for the specific delivery.
